These Terms of Service ("Terms") govern access to and use of Vcare HRMS (the "Service"), a payroll and human resource management platform provided by K-IT Services ("K-IT Services", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization, and "you" refers to that organization.
Vcare HRMS provides tools for workforce management, including but not limited to employee records, attendance and leave tracking, payroll processing, statutory compliance, recruitment, performance management, and related reporting. We may add, change, or remove features from time to time.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us promptly at hrticketing@k-itservices.com if you become aware of any unauthorized use of your account. Access to the Service is provisioned by your organization's administrators, and access levels are determined by the roles assigned to you within the platform.
You agree not to: (a) use the Service for any unlawful purpose or in violation of any applicable labor, tax, or data protection law; (b) attempt to gain unauthorized access to the Service, other accounts, or connected systems; (c) upload or transmit any content that infringes the rights of a third party; (d) interfere with or disrupt the integrity or performance of the Service; or (e) reverse engineer, decompile, or attempt to extract the source code of the Service except as permitted by law.
The Service is used by your organization to process employee, attendance, and payroll data. Your organization is the data controller for such data, and K-IT Services acts as a data processor, handling this information solely to provide the Service and in accordance with our Privacy Policy. You are responsible for ensuring you have the necessary rights and consents to submit employee data to the Service.
Where the Service is provided on a paid subscription basis, fees, billing frequency, and payment terms are as agreed between your organization and K-IT Services in a separate order form or subscription agreement. Failure to pay outstanding fees may result in suspension of access to the Service.
The Service, including its software, design, and branding, is owned by K-IT Services and its licensors and is protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service. You retain ownership of the data you submit to the Service.
We aim to keep the Service available and reliable but do not guarantee uninterrupted access. Scheduled maintenance or unforeseen issues may result in temporary downtime. For support requests, contact hrticketing@k-itservices.com or call 7675879089.
Either party may terminate access to the Service in accordance with the applicable subscription agreement. We may suspend or terminate access immediately if these Terms are materially breached, or if required to do so by law. Upon termination, your right to use the Service ceases, subject to any data retention or export obligations agreed separately.
The Service is provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by law. To the extent permitted by applicable law, K-IT Services shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service.
We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of India, without regard to conflict of law principles, unless otherwise agreed in a separate written agreement between you and K-IT Services.
